1) Jack Vinson, the appellant, is and has been a professor of mechanical engineering at the University of Delaware since 1964. In 1965 Vinson joined the Universitys pension plan and signed an agreement for salary reduction and an authorization for a payroll deduction. Five percent of Vinsons $16,000 per year salary went into his pension plan at that time. Vinson believed that the 5% contributions to his pension plan were being calculated according to his actual salary as increased over time. However, the University continued to base his contribution to his retirement plan on a $16,000 per year base salary. It was not until 1982 that Vinson became aware of this situation.
